Medical Negligence - Who can claim? - National Compensation Lawyers

The Law allows a person to claim compensation where they have been injured as a result of negligent medical treatment. Compensation can be claimed for physical injury, psychological injury and financial loss.

Medical negligence claims can arise in a number of different circumstances, including:

  • A treating doctors and specialists’ failure to diagnose an injury or condition;
  • A treating doctor or specialists’ misdiagnosis or delayed diagnosis of your injury or condition;
  • Inadequate communication from your treating doctor or specialist, a failure to inform or obtain the proper consent;
  • Prescription and medication errors;
  • Sterilization issues;
  • Medical errors during child birth;
  • Defective medical products.

If a family member has passed away as a result of inadequate or improper medical treatment, a dependent may have further compensation entitlements available.
