Are you covered under the ComCare Scheme?

If you have been injured:

  • in the workplace;
  • contracted an illness;
  • your health and wellbeing have been affected; and/or
  • you are a past or present employee of a Commonwealth Government Department, Australian Capital Territory Government, or any of the Current Licensees operating under the Commonwealth Compensation Scheme;

you may be entitled to a range of benefits and compensation under the ComCare Scheme.

Should you have suffered an injury or illness, it is important that:

  • the injuries which you have sustained and the circumstances of those injuries are reported to your employer and recorded in the Accident Report Book;
  • the Claim for Compensation Application Form which you lodge, records all injuries which you have sustained and their sequel;
  • you continue to lodge medical certificates on the prescribed form with your employer. Your treating doctor should record all injuries suffered on the medical certificates.

The ComCare Scheme provides two separate sets of rights and entitlements which need to be protected. Firstly, there exists a no fault scheme, this simply means that no one needs to have been at fault for you to have access to benefits, which include:

  • entitlements to weekly payments of compensation;
  • payment of medical, rehabilitation and like expenses; and
  • lump sum compensation if you have sustained a permanent impairment.

The ComCare Scheme provides further entitlements for pain and suffering and loss of enjoyment of life. In proceeding with such a claim, you are required to show the fault of your employer. Please note that different provisions apply if you have been injured by the fault of a third party (a party other than your employer).

You may be eligible for more than one benefit.
